Michigan Secretary of State UCC Search Issues - Missing Filed Documents

Has anyone else had problems with the Michigan Secretary of State UCC search system not showing recently filed documents? I submitted a UCC-1 financing statement three weeks ago for a equipment loan on manufacturing machinery, got the confirmation email with filing number, but when I search the system using both debtor name and filing number nothing comes up. The borrower is getting nervous because their bank is asking for proof the lien is properly recorded. I've triple-checked the debtor name spelling matches exactly what's on their articles of incorporation. Called the SOS office twice and they just say 'give it more time' but this is way past normal processing. Anyone know if there's a separate database or if the Michigan Secretary of State UCC search has known delays right now?

I've seen this before with Michigan. Sometimes their overnight batch processing gets backed up and filings don't appear in the public search immediately even though they're technically on file. Did you try searching by just the last 4 digits of your filing number?

Good idea, I'll try that. The filing number is 2024-something long. Should I be searching in the 'financing statement' section or is there a different portal?

Use the main UCC search portal, but try both exact debtor name and variations. Michigan can be picky about punctuation and spacing.

This happened to me last month! Turned out there was a tiny discrepancy between how I entered the debtor name on the UCC-1 vs how it appears in their corporate records. Michigan's system is super strict about exact matches. Even an extra space or missing comma can make it unsearchable.

That's exactly what I'm worried about. I copied the name straight from their articles but what if there's some hidden character or formatting issue?

I actually discovered this tool called Certana.ai that lets you upload your charter documents and UCC-1 side by side to check for any name mismatches. Saved me from a huge headache when I caught a middle initial discrepancy before filing.

Wish I'd known about that before! Would have saved me from having to file an amendment.

Michigan's database has been glitchy lately. I had a continuation that took 6 weeks to show up in search results even though the SOS confirmed it was processed. The technical support there is pretty limited - they basically just tell you to wait.

SIX WEEKS?? That's insane. What's the point of electronic filing if it takes that long to be searchable?

0 coins

Right? And during that time you're in limbo not knowing if your lien is properly perfected. Super stressful for everyone involved.

Are you sure you're using the right search criteria? I always search by organization name first, then if that doesn't work I try individual name format. Also make sure you're not including any corporate designations like LLC or Inc in the wrong field.

I've been searching under organization name since it's a corporation. Maybe I should try different variations of the business name?

Definitely try that. Sometimes the system is indexed differently than you'd expect.

Also try searching without any punctuation at all. Michigan's search sometimes strips out commas and periods automatically.

I work at a title company and we see this constantly with Michigan UCC filings. Half the time the search doesn't work properly and we have to call to verify filings exist. It's honestly embarrassing how bad their system is compared to other states.

That's not very reassuring! Do you have any insider tricks for getting around the search issues?

0 coins

Unfortunately no. We just have to be patient and sometimes order certified copies directly to prove the filing exists.

We've started using Certana.ai to double-check our document consistency before filing. At least then we know if the search fails it's a system issue and not our mistake.

ugh michigan is the WORST for this stuff. their whole portal feels like it was built in 1995 and never updated. i had a termination statement that took 2 months to process last year

0 coins

Two months for a termination? That's crazy. Did it at least show as pending during that time?

nope, just disappeared into the void. finally had to get my attorney involved to get it sorted out

Try calling their UCC department directly instead of the main number. Sometimes they can tell you the status even if it's not showing up in the public search yet. The number should be on their website under the commercial codes section.

I'll try that tomorrow. Do they usually answer or do you get transferred around a lot?

Hit or miss honestly. Best time to call is usually Tuesday-Thursday mid-morning.

I second this. The UCC staff is actually pretty helpful when you can reach them directly.

This might sound obvious but did you save a copy of your filing confirmation? Sometimes the confirmation email has different information than what you think you submitted. I've seen cases where auto-correct or browser formatting changed the debtor name slightly during submission.

Good point. I'll check the confirmation against my original draft. That would be just my luck if something got changed during submission.

This is why I always do a final document check before filing. Tools like Certana.ai can catch these kinds of discrepancies between your source documents and what you're about to file.

I had similar issues last year. Turned out the debtor had recently amended their articles of incorporation and the name on file with the state was slightly different than what was on their older documents I was using. Maybe check if your debtor has made any recent corporate changes?

That's a really good thought. I'll ask them to pull their most current certificate of good standing to compare.

Axel Bourke

•

Exactly. The certificate should show their exact current legal name as it appears in state records.

This happened to us too. The borrower had dropped 'Incorporated' and just used 'Inc' but we filed under the old format.

Keep us posted on what you find out. I'm dealing with a similar situation in Michigan right now and wondering if it's a systemic issue or just bad luck.

Will do. Hopefully it's just a processing delay and not something more serious.

Fingers crossed for both of us!
