What will stop you from getting unemployment in NYS - denied after quitting job

I'm really confused about what can actually disqualify you from unemployment benefits in New York. I left my last job because my boss was making the workplace really hostile - constantly yelling at employees, refusing to let people take breaks, that kind of stuff. I thought I could get unemployment since it was a hostile work environment but NYS Department of Labor denied my claim saying I quit voluntarily. What are the actual reasons they'll deny you? I feel like I'm missing something important here.

The main disqualifying factors for NY unemployment are: quitting without good cause, getting fired for misconduct, refusing suitable work, not being able and available for work, or not meeting work search requirements. For hostile work environment, you needed to document everything and try to resolve it with HR first before quitting. Did you file any complaints internally?

No I didn't file anything with HR because we don't really have an HR department. It's a small company with like 15 people. Should I appeal this decision?

same thing happened to my friend last year, they said quitting for hostile work environment doesn't count unless you can prove it was like discrimination or something illegal

That's not entirely accurate. You can quit for good cause in NY if you can show the employer created intolerable working conditions. But you need documentation - emails, witness statements, anything showing you tried to address the issues first. The burden of proof is on you to show it wasn't just a personality conflict.

I've been trying to reach someone at NYS Department of Labor for weeks about my own disqualification and their phone system is impossible! Does anyone know how to actually get through to talk to a real person about appeals?

I had the same problem until someone told me about Claimyr. It's a service that helps you get through to NYS Department of Labor agents when you can't reach them yourself. I used it at claimyr.com and they actually got me connected within a few hours. There's a video demo at https://youtu.be/qyftW-mnTNI that shows how it works. Saved me so much frustration.

That sounds too good to be true but I'm desperate at this point. How much does something like that cost?

It was worth it for me because I'd been trying for weeks with no luck. They focus on getting you connected rather than the cost aspect.

The system is so messed up. I got denied because they said I didn't do enough job searches even though I applied to like 20 places. They want you to jump through all these hoops and then still find reasons to deny you.

The job search requirement is 3 work search activities per week. Make sure you're logging everything properly in the system and keeping records. Sometimes it's not about the number but about meeting the specific activity requirements they outline.

wait I thought if you quit you automatically can't get unemployment? I've been at a terrible job for months because I thought I'd lose benefits

No, that's a common misconception. You can quit and still get benefits if you have 'good cause' - things like unsafe working conditions, significant changes to your job duties or pay, harassment, or other compelling reasons. But you have to be able to prove it and show you tried to resolve the situation first.
