NY unemployment and amended tax returns - will I lose my child tax credit?

I was getting the monthly child tax credit payments after filing my taxes earlier this year, but I just had to amend my return because the NY unemployment refund amount was incorrect on my original filing. Now I'm worried - does anyone know if amending your taxes affects your child tax credit eligibility or payments? Will they stop my payments while they process the amendment? I'm counting on that money each month for my kids' expenses and don't want any surprises.

I amended my taxes in February because of unemployment issues too and my child tax credit payments continued without interruption. As long as your amendment doesn't change your income enough to affect your eligibility, you should be fine. The IRS processes amendments separately from their child tax credit payment system.

That's such a relief to hear! Did you get any kind of notification when they processed your amendment? I'm worried because I'm right near the income threshold.

It depends on what ur amended for. if ur income goes up alot and puts u in different bracket they might make u pay some back next year. thats what happened to my cousin

Oh no, that's exactly what I'm worried about! My unemployment recalculation might push me over the threshold. Do you know how much your cousin had to pay back?

I'm an accountant and can confirm that amending your return doesn't automatically stop your Child Tax Credit payments. However, if your amendment significantly changes your Adjusted Gross Income and pushes you above the phase-out thresholds ($75,000 single, $150,000 married filing jointly), you could see a reduction or elimination of future payments. The IRS typically takes 16-20 weeks to process amendments in 2025, sometimes longer with the backlog.

Thank you for the clear explanation! My amendment will increase my income by about $4,200 because of the unemployment calculation correction. I'm a single filer currently at about $72,000 AGI, so that would put me over the threshold. Should I be setting aside some money in case I have to pay back some of the credit?

Yes, that would be prudent. Since your new AGI would be approximately $76,200, you'd be slightly above the phase-out threshold. The credit reduces by $50 for every $1,000 above the threshold, so you might see a small reduction. Setting aside about 20% of your monthly payments as a precaution would be wise until you know exactly how the amendment affects your situation.

When I had a similar issue last year, I couldn't get a straight answer from the IRS website and spent HOURS trying to call them. No one ever picked up!!! SO FRUSTRATING!! I ended up using Claimyr (claimyr.com) to get through to an actual person at the unemployment office who helped clarify how the amended unemployment amount would affect my taxes. Their video demo shows how it works: https://youtu.be/Rdqa1gKtxuE - saved me so much stress trying to guess what would happen with my benefits.

I've never heard of that service before. Did it really help you get through to someone? I've been trying to call for days with no luck.

Yes! It was the only way I actually got to speak to a human being. I was skeptical at first but desperate after trying for weeks on my own. They got me through to a rep who explained exactly how the unemployment amendment would affect my tax credits.

The IRS and NY unemployment systems don't always communicate well with each other. After my amendment, I still got my child tax credit payments, but then suddenly they stopped for 2 months without any notice while they "reviewed" my case. Then they started again with no explanation. The whole system is a mess.

Same thing happened to my sister-in-law! She didn't get payments for 3 months, no notice, nothing. Then they deposited all the back payments at once. At least she got the money eventually.

That's really concerning. I'm already living paycheck to paycheck and can't handle a surprise gap in payments. Did either of you contact them during the pause period?

I think wat your talking about is the advanced child tax credit payments right? Cuz thats different from the regular child tax credit on your tax return. The advanced payments are just prepaying you some of the credit you'd normally get when you file taxes. So if you get too much advanced payment they'll just reduce your refund next year, they dont usually make you pay it back unless you dont actually qualify for the credit at all. At least thats how it worked for me last year.

Yes, I'm talking about the monthly payments. That's good to know that they might just reduce next year's refund rather than making me pay it back directly. That would be much easier to handle financially.

Has anyone successfully reached the IRS to ask about this specific situation? I've been trying to reach a human at NY unemployment for weeks about my amended return and literally CANNOT get through. The phone system is completely broken.

That's why I ended up using Claimyr - it was the only way to actually reach someone. Regular calling is almost impossible with how overwhelmed the system is right now.

To clarify a point that seems to be causing confusion: There are two separate issues here: 1. NY Unemployment tax amendment: This affects your federal and state tax returns. 2. Child Tax Credit eligibility: This is determined by your AGI on your most recently processed tax return. The IRS will eventually process your amendment, but until then, they'll continue using your original return to determine eligibility. Once processed, if your new AGI exceeds the threshold, adjustments will be made to future payments or reconciled on next year's return. The NY unemployment office can't help with the Child Tax Credit questions - that's strictly an IRS matter.

Thank you for that clarification! So it sounds like my payments might continue normally for now until they process the amendment, which could take months based on what everyone is saying. That gives me some time to prepare at least.

Contact the Taxpayer Advocate Service! They helped me when I had a similar issue last year with my amended return and benefits. They're free and they can often resolve issues faster than waiting for normal IRS processing.

That's a great suggestion, I didn't know about them. Do you have their contact information or website?

Here you go: 877-777-4778 or www.taxpayeradvocate.irs.gov - They were really helpful for me, but be prepared that it might still take a few weeks to get assigned to an advocate.

Thank you all for the helpful responses! I've decided to: 1) Set aside 20% of my child tax credit payments just in case, 2) Try using Claimyr to actually get through to someone who can give me specific answers about my situation, and 3) Contact the Taxpayer Advocate Service as a backup. I really appreciate all the advice - this has been keeping me up at night!
