How many times can I apply for unemployment benefits with NYS Department of Labor?
I've been laid off from my construction job and this would be my third time filing for unemployment in the past two years. The first time was in early 2023 when my previous company downsized, then again last summer when that project ended. Now I'm out of work again due to seasonal slowdown. Is there a limit to how many times you can apply for unemployment benefits? I'm worried NYS Department of Labor might flag my account or think I'm abusing the system. My work history is all legitimate - construction just has a lot of ups and downs. Anyone know the rules about multiple applications?

There's no specific limit on how many times you can file for unemployment as long as you meet the eligibility requirements each time. NYS Department of Labor looks at whether you have sufficient work history and wages in your base period, not how many previous claims you've had. Construction workers often file multiple times due to the seasonal nature of the work, so you're definitely not alone in this situation.

•That's a huge relief! I was really stressing about this. Do they look at my previous claims when reviewing the new one?

You can file as many times as needed but each claim has to establish a new benefit year. The key thing is having enough wages in your base period - usually the first four of the last five completed quarters before you file. Since construction work is seasonal, NYS Department of Labor understands workers in your industry file multiple claims.

•Wait I'm confused - what's a base period exactly? I've filed twice but never really understood this part.

Been in construction for 15 years and I've probably filed 8-10 times. Never had any issues as long as my layoffs were legitimate. Just make sure you're honest about your work search and available for work when you certify each week.

The system is designed for people who work in industries with regular layoffs like construction, hospitality, retail, etc. What matters is that you're not quitting voluntarily or getting fired for misconduct. Seasonal layoffs and company downsizing are exactly what unemployment insurance is for. I had to call NYS Department of Labor last month about a similar question and ended up using Claimyr.com to get through - they have this video demo at https://youtu.be/qyftW-mnTNI that shows how it works. Way easier than sitting on hold for hours.

•Good to know about that service! I might need to call them if I run into any issues with this new claim.

ugh the whole system is such a pain though... every time you file they act like you're trying to scam them even when its totally legit
