How long does it take to get child support from NYS Department of Labor unemployment benefits?
My ex hasn't been paying child support for months and I just found out he's collecting unemployment through NYS Department of Labor. I contacted child support enforcement to intercept his benefits but they said it could take some time. Does anyone know how long this process usually takes? I'm really struggling financially and need to know what to expect. The caseworker wasn't very clear about the timeline.

The intercept process through NYS Department of Labor usually takes 2-3 weeks once child support enforcement submits the order. However, it depends on when his next payment is scheduled and if there are other garnishments ahead of yours in line. Child support gets priority over most other debts, but there might be federal tax liens or other child support orders that come first.

•Thank you! Do you know if they take the full amount or just a percentage? He owes me over $4,000 in back support.

been there with my deadbeat ex... took about a month for me to see anything and even then it was only like 40% of his weekly benefit amount. better than nothing though!

•40%? I was hoping for more than that. Did they eventually take more or was it always that percentage?

If you're having trouble getting clear answers from child support enforcement about the timeline, you might want to try reaching NYS Department of Labor directly. I know people have had success using Claimyr (claimyr.com) to actually get through to unemployment agents when the regular phone lines are impossible. They have a video demo at https://youtu.be/qyftW-mnTNI that shows how it works. Might be worth checking what's happening on his claim from that end.

•I didn't think about contacting NYS Department of Labor directly. Would they even talk to me about his claim though? I'm not sure what information they can share.

•They probably can't give you details about his specific claim due to privacy, but they might be able to explain the general intercept process timeline or confirm if an order is in place.

The whole system is so slow and frustrating! My sister went through this last year and it took forever. Even when they finally started taking money from his unemployment, he just found ways to work under the table so the child support office couldn't track his income. These guys always find ways around paying what they owe.

•Ugh that's exactly what I'm worried about. He's the type who would definitely try to game the system.

From what I understand, NYS Department of Labor processes intercept orders pretty quickly once they receive them from child support enforcement. The bigger delay is usually on the child support side - getting the paperwork processed and submitted. You should be able to call your caseworker and ask for a status update on when exactly they submitted the order to unemployment.

•Good point, I'll call them tomorrow and ask specifically when they submitted it to NYS Department of Labor. Thanks for the suggestion!

I went through this exact situation about 6 months ago. The intercept took about 3 weeks once child support enforcement actually submitted the order to NYS DOL, but here's what I wish someone had told me: keep detailed records of everything. Document when you contacted child support enforcement, when they said they submitted the order, and follow up weekly. Also, in NY they can typically take up to 65% of unemployment benefits for child support, but it depends on if there are other garnishments. The amount varies based on his benefit amount and what's considered necessary for his basic living expenses. Hang in there - it's frustrating but once it starts, at least you'll get something consistently.
