How long do employers have to respond to unemployment claim in NYS?
My boss fired me two weeks ago and I filed for unemployment the next day. My claim is still showing 'pending employer response' on my.ny.gov and I'm getting anxious about when I'll start receiving benefits. Does anyone know the actual deadline for employers to respond to NYS Department of Labor about unemployment claims? I read somewhere it's 10 days but not sure if that's accurate. Really need these benefits to start soon since I have rent due next week.

Employers have 10 calendar days from when NYS Department of Labor sends them the notice to respond to your unemployment claim. If they don't respond within that timeframe, your claim should move forward based on the information you provided. The 10-day rule is definitely accurate - it's in the NYS unemployment regulations.

yeah my old job never responded at all lol and my benefits started after like 2 weeks. dont stress too much about it

The 10-day response period is correct, but keep in mind that doesn't mean your benefits automatically start on day 11. NYS Department of Labor still needs time to review everything and make a determination. If your employer doesn't contest the claim, you should see movement within a few days after the response deadline passes. If they do contest it, that's when adjudication begins which can take much longer.

•This is exactly what happened to me last month. My employer waited until day 9 to respond and contested my claim saying I was fired for misconduct. Still waiting on adjudication 3 weeks later. Really wish there was an easier way to check what's happening with my case.

Just wanted to add that the 10-day rule applies to the initial response, but if there's any back-and-forth or if NYS Department of Labor requests additional information from either party, there can be additional deadlines. Make sure you respond quickly to any requests for information from your end too.
