Filed NY unemployment claim 2 months ago but can't reach anyone by phone - trying assemblyman
Just wanted to introduce myself to this group - I was in another NY unemployment forum but left because there were wayyy too many spam/political posts there. So annoying! Anyway, I filed my NY unemployment claim on 01/19/25, so it's been about 2 months now, and I'm still waiting like many others here. My claim status just says "pending" with no explanation. Every time I call the DOL, I either get disconnected or stuck in an endless menu loop. It's impossible to get through to a live person! I finally reached out to my Assemblyman's office about 3 weeks ago. His assistant has been sending emails to NYSDOL on my behalf requesting that someone call me. She said I should be hearing from someone in the next few days. I'm keeping my fingers crossed I get something soon. I've been tapping into my savings to cover bills and it's getting really stressful 😞 Has anyone else had luck getting help through their elected officials? Or found any tricks to actually speak with someone at unemployment?

Welcome to the group! Reaching out to your Assemblyman was actually a smart move. That's one of the more effective ways to get NYSDOL to prioritize your claim when you've been waiting a while. A couple things to try while waiting for the Assemblyman's office to help: 1. Call right when the phone lines open at 8:00 AM - sometimes you can get through before the system gets overwhelmed 2. Make sure you're still certifying every week even though you haven't received benefits yet 3. Check your message inbox on the NY.gov account - sometimes they request additional information but don't notify you by email or phone 4. If your claim says "pending" with no other status, it usually means they're still reviewing your employment history or wages Hang in there! The system is definitely frustrating but most claims do eventually get processed, especially once an elected official gets involved.

•Thanks for the tips! Yes, I've been certifying every single week, even though it feels pointless right now. And I check my message inbox constantly - nothing there except the automated confirmation when I first filed. I've tried the 8 AM trick a few times but by the time I get through the automated prompts, I still end up in the queue with everyone else. I'll keep trying though.

•Oh no, that's disappointing to hear. Did you end up getting your claim resolved eventually? If so, what finally worked?

I had a pending claim for almost 3 months! It was a nightmare. My savings was almost completely gone before it finally got processed. Hang in there!

The NY unemployment phone system is absolutely BROKEN by design! They don't want to talk to us! I've been dealing with this garbage system for years now and it only gets WORSE every time they "upgrade" it. I was pending for 11 weeks back in December and January - ELEVEN WEEKS with ZERO income and ZERO explanation! The assemblyman route sometimes works but it's still so slow. They're all overwhelmed with unemployment cases right now. The whole system is a JOKE and nobody in Albany cares enough to fix it!!!

•11 weeks?? That's insane! Did you ever find out why it took so long? I'm starting to get really worried about how long this might drag on...

•They said there was a "wage verification issue" that could have been fixed in 5 MINUTES if someone had just CALLED ME! Instead they let the claim sit there for almost 3 months! And then when they finally fixed it, they acted like they were doing me a FAVOR by giving me MY OWN MONEY that I've paid into the system for years!!! The whole thing is designed to discourage people from claiming what they're entitled to.

I was in your exact situation back in November. My claim was pending for 7 weeks with no explanation. What finally worked for me was using Claimyr to get through to an agent. It's a service that basically calls DOL for you and connects you when an agent picks up. Saved me hours of redial frustration. Their website is claimyr.com and they have a video that shows how it works: https://youtu.be/Rdqa1gKtxuE Once I actually got to speak with someone, they told me there was a small discrepancy between the wages I reported and what my employer reported. They fixed it on the spot and my payments started coming through about 3 days later, including all my backpay. The assemblyman route is good too, but in my experience, talking directly to a claims specialist is faster if you can actually get through.

•is that service legit? seems sketchy to pay someone just to make a phone call

•Thanks for suggesting this! I hadn't heard of it before. I'll probably give my assemblyman's office another week to see if they can help, but if I still don't hear anything, I might try this route. At this point, I just need to talk to an actual human who can tell me what's going on with my claim!

Sometimes your claim gets stuck in pending if there's an issue with your identity verification. Did you get an email asking you to verify your identity through ID.me? Sometimes those emails go to spam. I would check your spam folder just in case. Also do you have any work search activities documented? You need at least 3 per week and they're being more strict about checking those in 2025.

•I checked my spam folder and didn't see anything from ID.me, but that's a good suggestion. And yes, I've been keeping detailed records of my work search activities - doing way more than 3 per week actually because I'm desperate to find a new job!

In my experience working with clients navigating the NY unemployment system, claims that stay pending for more than 6 weeks usually have a specific issue that needs attention from a claims specialist. The most common issues are: 1. Identity verification problems 2. Employer dispute (if they contest your eligibility) 3. Multi-state wage investigation (if you worked in multiple states) 4. Prior overpayment issues 5. System glitches in the DOL database The assemblyman approach is often effective, but typically takes 2-3 weeks to get results. For faster resolution, speaking directly with a claims specialist is crucial. Make sure you have all your documentation organized: past pay stubs, separation notice from employer, work search records, and any correspondence from DOL. When you do finally get through to someone, having this information ready will help resolve your case much more quickly.

•Thank you for this detailed explanation! I actually did work in both NY and NJ last year (mostly NY though). Could that be causing the delay? And if so, is there anything specific I should mention when I finally reach someone?

•Yes, working in multiple states can definitely complicate your claim! In that case, NYSDOL has to conduct a combined wage claim investigation, which requires coordination with New Jersey's unemployment office to verify your wages there. This process often adds 3-4 weeks to the claim processing time. When you speak with a representative, specifically ask if your claim is held up due to a "combined wage investigation" or "multi-state wage verification." If it is, request that they expedite the interstate wage verification process. Having your NJ employer information and pay stubs ready will help tremendously. This is actually a very common issue that many claimants don't realize is causing their delay.

UPDATE: I finally got through to someone at NYSDOL this morning! After trying for weeks! The agent confirmed that my claim was held up because I had worked in both NY and NJ, just like someone here suggested. They needed to verify my wages from the NJ employer, and apparently they sent a request to NJ's unemployment office weeks ago but hadn't received a response. The agent put a note in my file to expedite the process and said she would personally follow up with the interstate unit. She told me it should be resolved within 7-10 business days. Just wanted to update everyone and say THANK YOU for all the suggestions and support. This group has been so much more helpful than the other forum I was in!

•That's great news! How did you finally get through to someone? Was it through your Assemblyman's office, or did you find another way to reach them directly?

•Excellent! I'm glad you got confirmation about the interstate wage issue. The 7-10 business day timeframe they gave you is actually pretty accurate for these cases once they've been flagged for expedited processing. Make sure you continue certifying weekly while you wait. And when your claim is finally processed, you should receive all backdated payments in a lump sum for the weeks you've been certifying.

•Yes! It took exactly 8 business days after speaking with the agent, but my claim was finally approved and I received all my back payments in one lump sum. Such a relief! If you're dealing with a multi-state issue like I was, definitely mention that specifically when you talk to someone.
