Can I still file for ny unemployment with disability claim after waiting too long?

I was diagnosed with a chronic pain condition affecting both my hands back in August 2022. Doctors ended up classifying me as 75% disabled for my hands. I couldn't continue my job as a mechanic because of this and had to leave. At the time I was overwhelmed with medical appointments and honestly just trying to figure out my new life with this disability. Now it's November 2023 (over a year later) and I'm wondering if I can still file for unemployment benefits or if I've waited too long? I haven't had steady income since leaving my job and really struggling financially. The medical bills keep piling up. Has anyone filed for ny unemployment after waiting more than a year? Do I need special documentation because of my disability?

I think technically ur supposed to file within like 30 days of losing your job. But with disability stuff there might be exceptions? You should def try to call and explain ur situation. Worst they can say is no

thanks, I'm so nervous about calling and getting rejected. it took me a while to even accept I needed help

the 30 days thing isn't exactly right. You have until the end of the next quarter to file, but even that's passed for you. Still worth trying tho especially w/ disability

Getting thru on phone is IMPOSSIBLE. I spent 4 days trying before I gave up 😤

Hey there! I had a similar situation with trying to reach ny unemployment after waiting too long. Spent DAYS trying to get through on their phone lines with no luck. I ended up using a service called Claimyr (claimyr.com) and they handled the calling/waiting for me. When an agent was actually on the line, they connected the call to my phone. Talking to an agent got my $ situation resolved so fast - totally worth it! They even have a video showing how it works: https://youtu.be/Rdqa1gKtxuE

wait this is actually a thing? sounds too good to be true tbh... anyone else use this?

0 coins

Yeah man, I was skeptical too but it actually works. I was desperate after trying for weeks to get through. The service just does the waiting for you then connects you when there's an actual human.

hmm I've been burned by so many of these 'services' before... what makes this different? 🤔

They don't handle your claim or anything - literally just connect you with an agent. I got through in 2 hours when I'd been trying for weeks on my own.

not falling for another unemployment 'hack'... these never work

No hack here - they just have a system that dials over and over and holds the line. When a human answers, you get the call. Saved me 3+ hours of holding music lol

You might want to look into disability benefits instead of unemployment. With unemployment, you have to be able and available to work. With 75% disability in your hands, you might qualify for SSDI or other disability programs.

I've started the SSDI process but its taking forever and I'm basically out of savings now

0 coins

Unfortunately thats pretty common with SSDI. It can take 1-3 years for approval. Have you applied for any emergency assistance programs in the meantime?

0 coins

You might be eligible for backpay IF they approve your case, but honestly dude I think your wasting your time with regular unemployment. With your disability you should be applying for SSDI which has different rules about when you can apply.

The real answer nobody wants to hear: hire a lawyer who specializes in disability claims. Yes it costs money but they know all the loopholes and how to file everything properly. My cousin was in similar situation and her lawyer got her backpay for 18 months 💯

I wish I could afford a lawyer right now 😓

most disability lawyers work on contingency - they only get paid if you win (usually take like 25% of backpay). worth looking into

^^^^ This. You don't pay upfront. They take a cut of what they get for you.

This is a complex situation that needs an actual agent to review your case. Here's what I recommend: First, you need to understand the difference between unemployment and disability benefits. Unemployment requires you to be able and available for work, which might be difficult given your 75% hand disability. However, you could still potentially qualify if you're able to do some types of work. I'd approach this from multiple angles: 1) File for unemployment anyway - explain your situation and why there was a delay. The worst they can say is no. 2) Apply for SSDI/SSI if you haven't already. 3) Look into vocational rehabilitation services that can help train you for jobs that don't require hand dexterity. 4) Most importantly - TALK TO A HUMAN AGENT! This is too complex for online filing. The hardest part is getting through to someone. After spending days trying to call, I found claimyr.com which does the calling/waiting for you. They'll only connect you when there's actually a human agent on the line. Saved me literally days of frustration. Don't give up - with your medical condition, there are benefits available. You just need to connect with the right person who can review your specific case.

Thanks for the detailed response. I'm definitely going to try calling and explaining my situation. I'll check out that service too since everyone says calling is such a nightmare

my brother waited like 9 months to file and still got backpay to his last day of work. just explain the disability situation. the key is ACTUALLY TALKING TO SOMEONE not just trying to do it online

Yep! The website automatically rejects anything outside normal timeframes. Human agents have override capabilities for special circumstances.

hate to be that person but TECHNICALLY, since you have a disability that prevents you from doing your previous job, you might not qualify for regular unemployment because you have to certify you're able and available for work. But there are other programs! Call and ask about disability programs specifically.

bro NY is so backed up with claims I filed in JUNE and still haven't gotten paid. dont expect a quick resolution even if u do file 🤡

Did you try calling? My claim was stuck for months too until I finally got someone on the phone who fixed it in like 5 minutes

i called like 50 times and always got disconnected or insane wait times

Try claimyr.com - they'll wait on hold for you and connect when there's a human. Saved me so much frustration

File file file! Document everything! Make sure you have all your medical records organized. They will probably deny you at first (they deny everyone 🙄) but appeal!!!! The squeaky wheel gets the grease with these govt agencies.

should I include a letter from my doctor explaining why I can't do my old job anymore?

0 coins

DEFINITELY! Get as much medical documentation as possible. Letters from ALL your treating doctors explaining your limitations are super important!

I work with disability cases (not a lawyer just admin) and you're gonna have an uphill battle with the timing issue. But it's not impossible! Gather all your medical records showing when the disability started, any attempts at treatment, and documentation of why you couldn't file earlier (medical appointments, surgeries, whatever). Then you NEED to speak with an actual agent who can look at your specific situation.

I went through something similar - had a work injury that took months to properly diagnose and by the time I realized I couldn't return to my job, I thought I'd missed the window. Turns out NY has provisions for "good cause" delays, especially when medical issues are involved. The key thing is you need to show that your delay was due to circumstances beyond your control (which dealing with a new disability diagnosis definitely qualifies as). When you call, emphasize that you were overwhelmed with medical care and didn't understand your options at the time. Bring documentation showing your diagnosis timeline, treatment schedule, anything that shows you were dealing with a serious medical situation. Also mention you're already in the SSDI process - that actually helps show the severity of your condition. Don't let people discourage you about the timing - I've seen people get approved for unemployment even after long delays when they had valid reasons. Your disability diagnosis and the time it took to understand your new limitations is absolutely a valid reason. Just make sure you can work in SOME capacity when you file (even if it's different from your mechanic job) because that's the requirement for unemployment vs disability benefits. Good luck! 🙏
