Can you get unemployment for no call no show NYS Department of Labor
I stopped showing up to my job about two weeks ago without calling in or anything. I was dealing with some personal issues and just couldn't handle going in anymore. Now I'm wondering if I can file for unemployment benefits through NYS Department of Labor or if they'll deny me since I basically just abandoned my job. Has anyone been in a similar situation? Will they consider this a voluntary quit or can I still get benefits?

Unfortunately, job abandonment (no call no show for multiple days) is typically considered a voluntary quit by NYS Department of Labor. However, you might still qualify if you can prove you had good cause for leaving - like unsafe working conditions, harassment, or significant changes to your job duties. You'll need to file a claim and explain your circumstances during the adjudication process.

•What counts as good cause? I was having panic attacks about going to work but I never got any documentation from a doctor.

same thing happened to my brother last year, he just stopped going and they denied his claim initially but he appealed it

•Did he win the appeal? What reason did he give?

•yeah he won but it took like 3 months total. he said the job was affecting his mental health and had some text messages from his supervisor being really nasty to him

You should still file a claim with NYS Department of Labor even if you think you might be denied. The worst they can do is say no, and you might be surprised. During the adjudication process, they'll contact your former employer to get their side of the story. If your employer doesn't respond or provides incomplete information, that could work in your favor. Make sure to document any reasons you had for leaving when you file your initial claim.

•How long does adjudication usually take? I need to start getting some income soon.

•Adjudication can take anywhere from 2-8 weeks depending on how complex your case is and how quickly your employer responds. If you're having trouble getting through to NYS Department of Labor agents to check on your claim status, I used a service called Claimyr (claimyr.com) that helped me get connected. They have a video demo at https://youtu.be/qyftW-mnTNI that shows how it works. Really saved me a lot of frustration trying to call.

THE SYSTEM IS SO MESSED UP!!! I know people who got fired for stealing and still got benefits but someone who's struggling mentally gets denied. Make sure you appeal if they deny you because sometimes the first decision is wrong.

•I feel for you but the rules are pretty clear about job abandonment. Still worth trying though.

When you file, be honest about what happened but emphasize any work-related issues that contributed to your decision. Mental health is taken more seriously now than it used to be. If you do get denied, you have 30 days to file an appeal and request a hearing.

•Should I mention that I was only there for 3 months? Does that matter?

•That might actually help your case - shorter employment periods sometimes indicate the job wasn't a good fit or there were issues from the start.

I went through something similar last year. The key is to document everything you can remember about why you felt you couldn't continue working - even if you don't have official medical records, write down dates when you had panic attacks, any interactions with supervisors that made things worse, or changes in your work environment. NYS DOL does consider mental health as a valid reason for leaving if you can show it was work-related. Also, don't let your employer's initial response discourage you - many employers will claim "job abandonment" but if you can show you had good cause, the adjudicator might see it differently. The process takes time but it's worth pursuing.
